These Terms of Service explain the rules for using LearnEnglish Canada, including our online learning materials, community features, and contact services.

1. Acceptance

By accessing or using LearnEnglish Canada (the "Website"), you agree to be bound by these Terms of Service (the "Terms"). These Terms apply to all visitors and users, including individuals who browse learning resources, participate in community pages, or contact us.

If you are under the age of majority where you live, you confirm that you have permission from a parent or legal guardian to use the Website and that they agree to these Terms on your behalf. If you are a parent or guardian and you permit a minor to use the Website, you are responsible for the minor’s activity.

LearnEnglish Canada provides education-focused English learning content and related services, which may include online courses, study resources, community discussion prompts, and event information (collectively, the "Services"). We do not guarantee that any course, resource, or community activity will meet a specific learning outcome. Progress depends on many factors such as your starting level, practice frequency, and language exposure outside the Website.

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the Website. You are responsible for your actions while using the Services.

If any account, registration, or gated access is offered now or in the future, you agree to provide accurate information and keep it up to date. You may print or save limited portions of content for personal study, provided you keep all copyright and proprietary notices intact.

You may not reproduce, distribute, publicly display, sell, sublicense, or create derivative works from the Website content for commercial purposes without our prior written consent.

We do not warrant that the information or learning materials are complete, fully current, or suitable for every individual learning objective.

7. Limitation of liability

To the maximum extent permitted by applicable law, LearnEnglish Canada, its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Website, (b) any conduct or content of any third party on the Website, or (c) unauthorized access, use, or alteration of your transmissions or content.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid to LearnEnglish Canada in the twelve (12) months immediately preceding the event giving rise to the claim, or 100 EUR, whichever is lower.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless LearnEnglish Canada and its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with (a) your use of the Website, (b) your violation of these Terms, or (c) your violation of any third-party rights.

9. Third-party links

The Website may reference or describe third-party platforms, tools, or services used by learners and educators. However, we do not control third-party websites or services and are not responsible for their content, policies, or practices.

Your interactions with any third-party service are governed by that third party’s terms and policies. You should review those policies before using third-party services.

11. Governing law

These Terms and any dispute arising out of or relating to these Terms or the Services will be governed by and construed in accordance with the laws of Ontario and the applicable federal laws of Canada, without regard to conflict of laws principles.

Subject to the Dispute Resolution section below, you agree that the courts located in Toronto, Ontario will have exclusive jurisdiction over any dispute or claim arising out of or relating to these Terms.

12. Dispute resolution

Before filing a claim against LearnEnglish Canada, you agree to attempt to resolve the dispute informally by contacting us and providing a brief written description of your issue and your preferred resolution. We will make a reasonable effort to respond within 30 days.

If the dispute is not resolved within 30 days of your written notice, either party may pursue a formal claim in accordance with the Governing Law section, in the courts located in Toronto, Ontario.

13. Termination

We may suspend or terminate access to the Website or Services at any time if we believe, in good faith, that you have violated these Terms, created risk for other users, or interfered with the integrity or operation of the Website. We may take such action with or without prior notice.

Upon termination, your right to use the Website will immediately cease. The following sections will survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and any other provisions that by their nature should survive.

14. Modifications

We may modify these Terms from time to time. Updated Terms will be posted on this page and will become effective 14 days after posting unless a shorter period is required by law or necessary to address security concerns.

Your continued use of the Website after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Website.
